ASSAULT & FAMILY VIOLENCE

Assault charges can arise from a domestic dispute, or other types of conflict. Often these charges boil down to a swearing match between you and another person. Unfortunately, no matter how justified you believe your actions were, if convicted you could be sent to jail, fined, and left with a permanent criminal record. If divorced, your visitation rights may be effected and your personal movements restricted by a restraining order.

If a restraining order is issued against you, federal law requires that you not have any firearms. Additionally, if your employer has a zero-tolerance policy regarding criminal convictions, you could lose your job. As your attorney, I do everything I can to develop a strong defense so you are not convicted of a crime as a result of a misunderstanding, false testimony, or a situation where you acted in self defense.

I have over 28 years experience in defending people charged with assault, aggravated assault, spousal abuse and other violent offenses. I know from experience how easy it is for someone to be arrested on assault charges based on false statements. The same is true of domestic violence charges.

Understanding the Realities of the Criminal Justice System

As your lawyer, my job is to do my best to develop a strong defense to prove your innocence. As your lawyer my job is to do my best to win your case by proving your innocence.

When someone calls 911 during a domestic disturbance and police arrive at the home, quite often somebody is going to jail. The husband and wife may each make accusations against the other and both may show physical signs of their conflict. However, it is typically the husband who is sent to jail, even when he may have just been defending himself.

Domestic Violence

Many district attorneys in Texas have changed their philosophy towards family violence cases. It used to be fairly easy for an attorney to get these cases dismissed if the wife or partner changed their mind and wanted to drop charges. Now district attorneys will prosecute these cases zealously, even if the wife or partner no longer wants to have the case prosecuted. I thoroughly investigate the relationships between of the parties and interview witnesses in an effort to develop a strong defense.
