I'm Robb Fickman, a criminal defense lawyer in Houston, Texas. In the past 26 years, I have represented many people who were under investigation for a criminal offense. I believe when a client is under investigation they should have a lawyer and their lawyer should be proactive in their defense.
I have studied the Art of War by Sun Tzu and have written and lectured on its application to criminal cases. I believe, as in the Art of War, that you win in preparation before you get to the battlefield. If you are under investigation for a crime, I believe the best time to win your case is before you are even charged.
I have represented people who were being investigated for all types of crimes, including:
- Mortgage brokers who were under investigation for fraud charges or other white-collar crimes.
- School teachers who were under investigation for an alleged sex offense with a student.
- Drivers who have been in a fatal car accident and who are under investigation for negligent homicide.
During a criminal investigation, I serve two roles. First, as your lawyer I will defend you. I will stand between you and the police to make sure you don’t do anything or say anything that damages your position. I will aggressively protect and assert your rights. As your lawyer, it's easier for me to say no to the police, than it is for you.
Secondly, I will conduct my own investigation. I often associate my investigator, but typically I participate in interviewing all key witnesses. My goal during the investigative phase of a case is to develop enough evidence to persuade the government or a grand jury, that you are not guilty and prevent the filing of any charges against you. Over the years I have compiled numerous packages which included affidavits, witness statements, photographs, diagrams, and legal documents. I present these packages, when appropriate, to the prosecutor and grand jury in an attempt to clear my client of the charges.
